Who is at fault

Simple breach of contract. You contracted to buy LAUPA cases and they supplied a mix. They should be liable for any losses you sustained. But glad it was all sorted without need to fall out - and get solicitors involved - it's never really worth it financially or inconvenience wise

That was the assumption I was working on, it being a "normal" over the counter/internet purchase. But even if there was small print that would have to have been brought to the purchasers attention prior to the contract being settled. And in any event, the fundamental purpose of the contract was to supply LAUPA brass to the buyer. Any small print to amend that would have to stand up to harsh criticism by a court and especially a small claims court. But we are getting into semantics, everything settled amicably and thats the important thing

Nice concept, but since when have you ever known of a seller and/or purchaser in a retail deal bringing up the subject of the finer contractual points of the Ts and Cs of sale?

If the retailer doesn't then he can't rely upon them - basic 1st year Contract law. Theseus (sic) are the rules Virbius :-|
