Buying Section 5 bullets from EU by post ????

Ok people keep saying you can legally buy Section 5 bullets from the EU and they will be posted to your door in normal post quicker and cheaper than from within UK with all the problems that means

So how exactly does this work as far as i can see you need to be a Section 5 RFD and apply for an import licence and is covered by the EU weapons Directive

As far as I'm aware your FAC qualifies as your import licence.

read the PDF the RFD is not allowed to use his personnal FAC

and the only ref to FAC used with no licence is from outside the EU

Im sure its some where but want it pointed out in the legislation not a bloke in the pub said if you know what i mean

so starter for 10 from above PDF is section 6 and 7

so yes my FAC had a section 5 authority to possess S5 bullets so complies with part 6 above

part 7 says you still need a import licence for any country


this says your FAC is good for import BUT only from countries NOT in the EU

Non-commercial imports of firearms, their components and ammunition

17.An import licence is not required for the personal import from outside the EU of firearms covered on aFirearm Certificate, Shotgun Certificate or a British Visitors Permit (BVP) as long as your domesticauthority is presented to Customs at import.

Transfers of non-prohibited firearms and ammunition to the UK from within the EU
22. For transfers within the EU, the provisions of the EU Weapons Directive apply. A transfer licence is required from the transferring member state for the transfer to the UK of newly acquired firearms. There is no import licence requirement as long as the transfer licence accompanies the firearm to the UK and you have the domestic authority to possess it. This also applies if you transfer handguns to Northern Ireland and the Isle of Man. A European Firearms Pass and BVP is required for transfers by EU residents from another EU Member State to the UK.
Good luck with the transfer license from the transferring member state. Bullets aren't classed as firearms in most EU countries.

The whole point of a flow chart is you start at the top and work your way down otherwise it would not work... you could apply any answer to any question!
 
The way that I understand it and that has been argued on here many times in the past, put in the simplest of terms while its not legal to post expanding bullets in the U.K. it's not illegal to receive them (provided you have the authority on your FAC to possess) that have been posted to you from outside the U.K.

I think it does need an import licence but the link posted above by pine martin does say the Customs will accept your Authorized FAC as an import licence (meaning they are treating it as Section 5 items not components of ammunition

Im not disputing that its discussed etc I was looking for exact Legal traceable law at XXXXXX.gov.uk Section XYZ paras 123 etc

bearing in mind the doc i put up as tracable stated Section 5 Needs an import licence end

looks like BASC got that in 2012 that your FAC authority is accepted in luei of the import licence hopfully its not changed as teh link has disappeared
 
The key to this relates to the fact that we have no separate S.5 Authority for possession of expanding bullets/projectiles and therefore the provisions of items 6 & 7 regarding import licencing do not apply - your FAC is not a S.5 Authority - they can't issue an import licence if there is no specific S.5 Authority issued by the Secretary of State.

Item 8 is the one that we come under - our authority to possess is already on our FAC as the 'expanding condition' we all have if shooting live quarry. Thereafter the requirements relating to personal importation from within or outwith the EU apply.

Don't forget that in the rest of the EU, where and if they have fully harmonised with the Weapons Directive, there is no restriction on expanding for hunting - so item 10, the requirement for a 'transfer licence' from the member state does not apply. It is only the UK that has this stupid categorisation in place, so a workaround is required both for domestic possession/use (our 'expanding condition'), and our relations with other States which have no restrictions in place.

A Dealers Open Individual Licence is not validas it does not include items falling to Section 5 of the Act.

if a dealers personnel OPEN Licence is not valid is anybodies ......... but what if it Does inlude S5 Ammo im sure they would be aware of that case and should have put in the clause unless authorized for S5 for wildlife etc

You are confusing a Dealer's Open Indvidual Licence (OIL) which is an Import Licence, with his FAC. ;)

lol yes sounds about right :D

think i need to up my Allocation as its not worth buying 200 bullets (well technically i need 197 as i have 3 dummy rounds made up for set up and they count :( )
 
I emailed the government department on this in order to prove to a friend it was perfectly legal. I will post the official reply tomorrow but in a nutshell I was told that any ammunition components were not restricted (primers and powers may be restricted by courier companies but not legally by import) but ammunition ​(complete rounds) you couldn't import yourself.

That's interesting. How do they explain the thousands of complete rounds that are exported and imported every day when shooters travel abroad for hunting, competitions, etc. etc. AFAIK it's not an issue to purchase complete rounds when abroad (especially within the EU) provided the seller is happy to supply them to you, and then bring them back to the UK within the authority of your FAC regarding calibre/cartridge and quantity limits.

only 15eur shipping from Strobl for 200 6.5 bullets.. don't think that's bad at all.. works out at approx. £68/100 Oryx... which is about what you would pay for them in the UK (if you can find any!!!!) and they will be delivered to your door.. so factor in the fuel needed to get them in the UK and it's a no brainer!!

The only issue I have with Strobl is you have to pay by bank transfer which is a PITA with non UK accounts.. would rather pay by card or paypal!

definalty a bargain my local gun shop is getting quoted min 75pounds shipping for S5 ammo even 1 box from teh UK distributor due to the Costs the Courier is piling on for S5
parently over 100 boxes is free

so isnt gettin in any
