    Application for open certificate

    Hi i have been told that my application has been turn down that you have to have 5 years be being consider for a open ticket i know this get some stick on this site but this seems very unfair thats some forces will grant this but not all i go out most week ends with my rifles .i visit the ranges days with the BDS etc what can you do or say .i have asked for the resons to be sent to me in wrighting

    i got mine fully open after only having my fac for 2 years, but it was one hell of a fight.

    its all about proving you have the releavent experience/qualifications help/safety more safety etc etc.

    it is possible to get it opened if you require the rifle for work, as having a closed ticket would stop you from earning a living (human rights).

    each case SHOULD be taken and accessed on its own merits (down to you to prove your suitable) but some forces say 5years blanket.

    do everything in writing and do you homework if you know what i mean.

    Book some stalking in the Highlands.... none of the land has been cleared up there, so you can explain to your FEO that without an open ticket you will be breaking the conditions of your cert.

    DJC,

    You are going about it the right way.

    Be polite but ask them in writing for the reasons why they consider you personally as unsuitable to have your FAC 'opened' given your esxperience with firearms. Request their response in writing, and if they state that it's some force policy for FACs not to be opened until first renewal then you have something to work on. It's important to get them to recognise and address your individual situation and not talk it round to some blanket policy. The HO Guidance is quite clear on that point.

    this started when i put a land check form in to have new land checked .i rang up about 21 days later as i was told they have 21 days in which to check .i was told it could take weeks as they are short staff etc .i then said how do i go about get my ticket changed from closed to open .reply was send in a letter from mentor and letter from my selt explaied why etc and this would be delt with .4weeks pass i got a letter saying it has gone out to FEO to carry out more enquierys .the same feo who is doing land check so i rang the feo i was told there no way till 5 years are up and thats that.so the next day i rang fire arms dept and spoke to the person who told me to right in and he said the same thing you will not get open till 5 yr it our policy so i have asked for a written reply of refuseal

    If you can get loads of permission, bombard them with a new piece of land every fortnight or after getting one piece passed put in for another. Even small bits of land and try and show you have done your homework and marked all foot paths and hazards. Point everything out as if your doing their job. If you have shown your competence in identifying hazards your more likely to get it. If you have had your licence for 3 years then you should be able to get it. If your just target shooting then you probaly struggle

    Sadly you have no right of appeal against conditions appended to the certificate. You can only appeal a failure to issue, not conditions. The only way you could effectively appeal them is to refuse to accept the conditions at the time of issue, which then becomes a refusal to issue and you end up getting caught up in years of legal wrangling, with no possiblity of a ticket, and a "refusal to issue" recorded on your file. Let's face it, they have you stitched up whichever way you look at it!

    and this is why im in the process of moving to canada, im so sick of the firearms laws ove rhere they are a joke, as stated maybe get some stalking booked in the highlands
