    High seat position

    Does anyone sight high seats in trees that border country roads?

    yes, but not roads that are used by the public if that's what you mean.

    what's your thought/question on the subject?

    Yes,why not?No different to being on or near a public footpath or bridleway???

    I want to fox shoot a couple of large flat fields and the only trees border a public road

    (In Scotland) to discharge a firearm within a specific distance from the centre of a public highway is an offence. Think it is as little as 50 feet for shotgun ...cant remember if its the same for rifle or is its more. England will probably have different laws but would be surprised if they dont have something similar

    In England its 50 feet from center of highway and only if you cause distress(frighten etc) the users or words to that effect ie no different to footpaths etc....

    I was led to believe, by a former Policeman with whom I stalk now and again, that they (the public) need to have reasonable cause to fear for their safety for it to be an offence. I suspect that common sense must come into it as well. I would be delighted for someone to clarify...

    No Craig it's you!

    Highways Act 1980. Section 161 applies:

    (2)If a person without lawful authority or excuse—

    (a)lights any fire on or over a highway which consists of or comprises a carriageway; or

    (b)discharges any firearm or firework within 50 feet of the centre of such a highway,
    and in consequence a user of the highway is injured, interrupted or endangered, that person is guilty of an offence and liable to a fine not exceeding level 3 on the standard scale.

    For the offence to occur the part I've highlighted above must be applicable.
