    Variation issue

Hi all , I have had a firearms open license now for over 15 yrs and only used a 22rimfire and 17 hmr , I recently put in for a variation for a 243 on the land I stated it would be used on , after my visit from the FAO I was told I could have any other calibre upto 243 but not the cal I requested ? The reasons were they reckoned I would struggle to get it approved on the land stated and would be a lot of messing about etc . To cut along story short I explained I wanted that cal to enable me to shoot both fox and deer cutting down the need for 2 different cals , his response was that I needed to state what purpose that cal was solely being used for and couldn't accept my purpose as a acceptable reason ? I agreed then to a 223 on which he accepted I could have ( my fox rifle ) and now own a nice Remington hb , but now I have acquired 2 more larger farms who have both requested I sort the deer out as well as everything else so have put in for a variation again with signed BASC permission letters stating this and have requested a 243 , what do you think my chances are of obtaining one now ? Thanks Wally .

where abouts in east yorkshire are you,
stick with it and if you have a letter from landowner stating you have fox and deer that is good reason. you dont say if you have done any deer stalking so that might be the sticking point as they might want you to have some experience. I would have stuck to the 243 as they do tend to try and sway you, why would they give a 223 but not 243 on that piece of land? unless they are asking for experience/dsc1? . just go through the land with them explaining all the danger areas that you have like footpaths or houses and explain how you will be shooting on the ground. if you can give us some more info we might be able to help abit more, atb wayne

The technical term for this is '*****'. Your licensing authority are being obstructive and incompetent.

The legal position is that once you have a FAC, the ONLY thing you have to do to add a new firearm of ANY legal kind is to show that you have 'good reason' to possess and use. All that needs is legal permission to use the gun somewhere, which does NOT have to be in writing, and the stated quarry likely to be present on the land at some time during the year - that's it!

Police checks of land are not in the Firearms legislation, although it doesn't say they can't do them.

Effectively, what your licensing uathority are doing is refusing your application for a variation, and you have a right of appeal to the courts, which will apply the LAW, not some nitwit police 'policy'

If you are a SACS member, contact me and we will get it sorted out for you with our legal fees expenses - if not, you'll need to find a good solicitor who specialises in Firearms appeals - if you don't know one contact me and I'll give you a contact name.

Everything else being in order, about 99.7%. Any messing get BASC involved as this is what you pay your sub for. Good luck!

I had the same problem, initially I asked for 17HMR , 22RF and 243 as a long range fox gun and to 'future-proof' for deer shooting to save having another rifle later on. Devon and Cornwall refused my 243 but gave me 223, which I have not filled as I don't want to buy twice. Luckily I move in a few months and will re-apply for a variation in a few months to my new force (Lincs).

Sounds like with deer permission though you should be in a much better place.

If you have permission for deer then surely they must grant you .243 as that's the minimum cal for deer in England?
