Help: UK E bay seller refusing to honour products 3 yr warranty

In December 2020 my son brought me an on balance carat scale from UK seller camden_market_place

It was advertised as having a 3 year warranty.

I use it for weighing powder and up till last month it worked faultlessly. However it stopped working and having replaced the batteries x3 it still will not turn on.

THEY STILL STOCK AND SELL THE SAME BALANCE.

First response from them was its over 2 yrs old and wont repair or replace.

Strange as it was purchased 29/12/2020 so not yet 24 months old!

Son pointed out its listed on their sellers page as having 3 year warranty.

Their reply: As I said, long time has passed,So, I can't help to you, but you can contact the company.

Son paid by PayPal so may be able to get a refund but it will be a tedious process.

Point is I need an electronic balance and I am dammed if I should shell out another £50.

What are my rights? If need be I am minded to take it to the small claims court.

I have know idea who the UK importer is.

Also no name for the owner of the ebay shop but there is an address.

Whats the SD collective view on how best to resolve this?

Consumer Rights Act. Google that.

Your contract is with the seller. Sue them. There is what is called the Simple Procedure which kind of replaces the Small Claims Court.
 
EBay is a bit of a difficult one as it is an auction site. However if the company you bought from offers a 3 year warranty then it is a different thing. In theory, your agreement is with the seller, not the importer.
The problem of course, is for the money involved is it worth the hassle? I would certainly put a complaint into PayPal and see what happens.
 
The idea of simple procedure sounds good but a quick google search seems to be a Scottish system, no version for England.

Try eBay, but you’re contract is with the seller, if the item is under guarantee you are entitled to have it repaired or replaced.
The small claims court is where I’d go, it costs you very little and gets a legally binding ruling.

but no guarantee the seller will honour it without expensive enforcement and for just £50.00?
i would go paypal/ebay as if the seller does a lot of business that way they probably do not want to be banned from ebay.

True, but if you get an order against the seller and they refuse to honour it you have a much better case to take to eBay.
A lot of faff for £50 though….
 
I had similar with ebay/paypal.
Was told bullsh=t by both ,in the end paypal told me to claim from my bank as my bank had paid them. My bank basically laughed and told me it was paypals responsibility which it was.
in the end I accepted I d been ripped off.
Then I left bad but true feedback about scumbag seller ONLY TO HAVE EBAY REMOVE IT 2 DAYS LATER AT SELLERS REQUEST!!!!!!!!!!!
BOTH COMPANYS ARE FULL OF CRAP.
 
Take screen shots of the proof of 3yr warranty claim. Raise claim through ebay and paypal and wait. Will be hard as it is over 60days but if they are still trading on ebay, you will find it possible.

I like ebay. I recently had an erroneous fee put through when I sold some items. It was a bit of a funny one as the listing was via one of their offers whereby you get 80% off final transation fees. The item went unsold first time round but then without me realising it was autorelisted and sold (funnily for a much higher price than I thought poss) the 2nd time round. Then the fees came through and were 100% rather than the 80% off. I thought this was a bit rich as the initial listing had been done via an offer and it seemed harsh to then rescind that offer after they autorelisted the item.

I contacted ebay and was amazed at how quickly i was put through to a nice Irish girl. Turned out I had autorelist set to "on" in my settings and that because it then listed outside the offer window, I had been billed fully for the services. She refunded it and apologised and said she could see I had hundreds of transactions and a 100% record both selling and buying. I thought I would have no luck but was pleasantly surprised how easy it was.

Give them a call. £50 is £50. Half a tank of derv and why buy a new set if the old ones are warrantied (which does seem odd for such a cheap set of scales but if that is what they offer, then they should stick to it)
 
for £50 you're wasting your time pursuing this extensively. Based on the sellers response you're not going to get anywhere unless taking them to claims court, which to be frank, isn't going to be worth the hassle.

maybe write them again and state that you will report them to ebay for fraud which might close their account, and you will take small claims court action unless a replacement unit is shipped within 3 working days. if they don't respond positively to that, sit back, have a wee dram and reflect on things worth worrying about,...then buy a new one from a different vendor ;)

Well its a court order and sending Balliffs adds to the costs for the seller not the purchaser.

Depends how ****ed off the OP is really.
 
These EBay scammers rely on people not bothering because it’s “just £50”
I don’t use eBay for this reason, amongst others.
I would encourage you to proceed with a claim of some kind where possible.
