Is it legal for passengers to sit in the rear of an open top defender 90, if they are sitting on the wheel arches, kind of like a bench seat both sides?

Do the wheel arches have type approved seats and seat belts fitted to them?

If not, it’ll be the same answer as the question “can my passengers surf on the roof whilst I drive down the M6?”

I’d there’s no seat fitted on your arches, it’s not a seat.
 
Export trim have a number of seat options, I’d suggest forward facing are most suitable if your passengers don’t want t to be seriously injured in the event of a crash.
 
My last Defender was a 9 seater, 2 in front, 3 in row behind then 3pairs of two seats opposing each other in the back.
Soon after that I think they outlawed the back opposing seats, possibly because the only had lap belts and the centre seat in the second row had a lap only belt. Newer Defenders had less seats.

We had an earlier series Landy that seated 12.
PPs. In one Defender I had the cubby box between the front seats was replaced by a seat, again with a lap belt.

Are you talking on public roads or on an estate/private road?
Have been a passenger on bench seats on an estate vehicle - no seat belts and slow driving along estate tracks.....definitely would not choose to do it on a fast or public road. Added to that, not very comfortable.
