Fac conditions

A friend of mine from down south is wanting me to take him out on a bit of ground I have in Scotland. This is no problem, as I am allowed to do so.
I was reading his certificate conditions just to make sure he can use his own rifle and his conditions state that he can use his rifle (deer legal) for any lawful quarry on ground he has permission, which has been passed by the chief officer of police for that area.
I was on the understanding that no ground gets passed in Scotland now as everyone has an open cert.
So does this mean as long as my friend has permission, he can shoot anywhere in Scotland?

My understanding is that all land in Scotland is deemed to be passed by the Chief Officer, therefore someone with a "closed" ticket in England could shoot on any land with permission in Scotland.

(But for the removal of doubt he could just ask for his FAC to be opened).

Yes, that was my sort of understanding too.

I don't think that it would be safe for you can assume that, just get your friend to explain the situation and request that the condition on his FAC be opened up.

No ground in Scotland requires specific clearance, merely the permission of the person who holds the rights. The onus is squarely on the shooter to ensure any shots are safe and appropriate

That’s not how the condition works though, a condition of the shooter’s certificate is that he can only shoot on ground cleared by the police. If the ground is not cleared he cannot legally shoot, it doesn’t matter if that is England, Scotland or Wales.

The fact is no ‘closed’ certificates are issued in Scotland so, for Scottish shooters at least, no ground needs to be cleared.

He either needs to get the certificate opened or use the OP’s rifle under the estate clause (assuming the OP’s written permission satisfies the clause).
