Fenn Traps Question

If you are using fenns the entrance to the tunnel must be restricted to a 25mm opening to prevent stoats from
entering the trouble is an opening of this size will also restrict other species.

Many keepers are using 25mm weldmesh on tunnel and rail traps to stay within the law for the control of weasels
which are excluded in the new law.
 
General wisdom is to stop using them if there are stoats one the ground because the offence is catching the stoat in a Fenn not trying to catch one.

Unless you can categorically guarantee not to catch a stoat with the measures you employ (and still catch target animals) I would steer clear.
 
sorry dan but i have to disagree unless a president has been set i cant see you are correct, if you have taken reasonable steps bi catch is bad luck, its the intent or neglect that would have to be proven. i dont see how you could exclude a stoat yet catch a rat or squirrel
 
It would be up to an individual to justify their actions in court if they were prosecuted for catching a stoat in a non approved trap I.e Fenn The general consensus appears to be that fenns should not be used where stoats are likely to be encountered, use a Doc
 
It’s been made pretty clear - you might get away with one but you won’t get away with 2.

Sensible (but expensive, which is not an excuse) approach is to swap the fenns out for something approved.

Getting caught falling foul of this sort of thing is very bad for everyone - be careful because you don’t want to be the one setting the precedent. If you catch a stoat in a fenn trap, there is no excuse - you are illegal, the fact it happens is all the proof that is required.
 
OK thanks guys for reply's I'm still confused :confused: Iv'e squirrels & rats around my hen pen, Is it still legal to set Mk Fenn's in tunnels with intention to catch squirrels & rats ?
 
Yes but if you get caught with a stoat in it you could be in big bother - better to use something that is legal for everything if you can.

You have a defence if you can show that you had good reason to think you weren’t going to catch a stoat in the trap (Either through their absence or your ingenious baffle system for instance) but that would be somewhat compromised by the fact that you will be trying to defend the fact that there was a stoat in the same trap you are arguing couldn’t catch one.

We had a fenn trap in the hen run because in 4 years I’ve never seen a stoat here but saw one last month so it’s been taken out, it’s very in likely you will a) catch a stoat and even more unlikely that b) you get caught Catching a stoat but why risk it.
