On duty police and off duty police.

Another rabbit hole. My eleven year old was watching something on You Tube where the narrator was saying what was illegal in the US State of Ohio. So I tld him that in the village where we live it is illegal to keep a pig in your back garden and illegal to have a takeaway "fast food" outlet. Which is why the village in the sixty plus years I have lived in it has never had a fish and chip shop, a chinese takeaway or any some such. Whereas the next village but two miles away has both.

This then got on to the old Town Police Clauses Act that it is, or was, illegal to serve food or drink to a police officer on duty unlike in "The Simpsons" where Chief Wiggum is continually eating doughnuts. So my son then asked how you could tell they were on duty and I said that in past days they used to wear a banded armband on their arm but they don't now. Which those of us of a certain age will recall.


So he asked how then do they tell now? Kids! You love them don't you! So I said I don't know. So SD members how do you know now?
 
I’m more interested in why you can’t keep a pig or have a chis and fip shop.
Always been the case in fact as far back as time remembered. Some local byelaw about the pigs so we always were told. Ditto fish and chips but now of course it'd be refusal for planning permission. There did used to be a mobile fish and chip van once a week a time long before covid that was maybe a decade plus ago. Chickens not at all an issue. But pigs no. Not allowed.

I, ... ... ... of ... ... ... do solemnly and sincerely declare and affirm that I will well and truly serve the King in the office of constable, with fairness, integrity, diligence and impartiality, upholding fundamental human rights and according equal respect to all people; and that I will, to the best of my power, cause the peace to be kept and preserved and prevent all offences against people and property; and that while I continue to hold the said office I will to the best of my skill and knowledge discharge all the duties thereof faithfully according to law.

Unfortunately, some clearly forget what they attest.....

We swore something similar in HM Forces

Though not borne of this country, I’d not forget that oath

It was to Queen and country

Doesn’t extend to Westminster automatically though 😎

Some houses have restrictive covenants preventing the keeping of pigs, chickens etc. It'll probably be enforced by the local landowner who sold off the land for housing and wanted to keep it as "nice" residential rather than smallholdings.

Not a bylaw but the effective is the same.
 
Here’s another thing to put into the equation in this day and age of blame etc,Say an officer was off duty and chased a criminal and injured himself or said criminal would he be insured.
 
Different wording to the Oath of Attestation to the one I swore a good few years ago.


As to on or off duty.... If I am on duty I am being paid.
If I am off duty and `I do not act if I see something that needs dealing with and do not act, then I am in neglect of my duty.

As soon as I deem it necessary, I can put myself back on duty.... (remember that you will have to explain to the Sgt/Inspector when you claim your minimum 4 hours and double time for rest day working.....best be worth it, and if you do it too often you will not like the jobs you get given to deal with)

Only ever done it once when I caught a lad stealing a motorbike and had to use a little force to get him to put down the screwdriver and not use it, and to remain while on duty people arrived......hence the back on duty for the time to write statements etc)

the long and short of it is you are a Warranted holder of the Office of Constable 24/7.



 
I read this more as a collection of antiquated laws. Our US Politicians (of all stripes) love to a)spend money and b) write new laws (often with a catchy name that forms an acronym)

What they don’t like to do is a) have anyone question their actions and b) delete/redact/repeal old stupid laws such as “a prohibition to catch fish with a lasso”

In my idea of a perfect world - any new law must include the repeal of at least 2 related laws

Probably a restrictive coventant put on the properties by the original seller of the land.
