Control of stags eating hay fields

Is a Portek bird scarer an answer? I have listed one in SD Classifieds. The one that uses calor gas and a battery either 12v externally placed leisure battery or its own internally housed battery to make a bang to scare off birds? After dusk it may be anti-social however.
 
Nope. I just checked.

Sec 7(1) states "cultivated land, pasture or enclosed woodland".
Sec 7(3) defines what deer may be shot out of season for crop protection purposes, and what constitutes a crop.
Sec 7(2) states that "an authorised person" (ie, occupier, member of occupier's household, occupier's employee or any other person having the right to take deer on the land (eg, sporting rights holder or person authorised by him)) "can also control any deer, on any land, at any time, with a shotgun which is not less than 12-bore and is loaded with AAA shot or a single non-spherical bullet". Provided that the conditions of Sec 7(3) are met.

I am of the opinion that Sec 7 definitely covers the OP's situation, and that provided the occupier of the land pays @Buchan for providing the service he can crack on with either shotgun or rifle.

Yes. You are right. I had confused myself with the word "enclosed" in s7 which relates to woodland but not other land that is cultivated. Thank you for putting that right.

What about putting up some jackets on a cross, like scarecrows put a few up and maybe some scent on them, surely that should deter them, worth a try, how many deer are coming in, ? , must be very annoying,
 
I’m baffled by the angst that develops in these situations.

As @VSS has shown, the law is fairly clear.

Moreover, even if it wasn’t, realistically, are the Police actually going to do anything? Farmer authorises licenced agent to shoot a pest causing demonstrable damage on his own land? No chance.

I would love to see the figures on prosecutions for out of season deer shooting. I would put money on it being in the low single figures, and even then only when associated with more serious offences.

And of course just up the road, there is no close season on males. While they’re separate jurisdictions, it does mean that in an era where police and CPS are having to make decisions about which cases to pursue, an out of season case goes straight in the bin.

None of the deterrents advertised, sold, suggested work... be it lion poo, human hair in tights hung on the roses, weeing in your garden, acoustic repellents, olfactory repellent...etc

Deer are so wise that they work things out in a matter of hours and days if it's actually a threat or not and will stand there right next to the deterrent munching away on stuff after a relatively short space of time.

The only thing that works, provided you maintain it and it is of adequate spec, is deer fencing.

A rifle is great but it only works when the DM is on site...

Quite a political area

Prevalent and vocal antis in the immediate vicinity who have caused issues for a number of years on other areas where deer managment is legal in the county concerned

Is it worth subjecting yourself and your fac to an investigation and subsequent loss of weapons during said investigation if a compliant were made with added stress to oneself, family and landowner

Mitigation may have been tried but knowing the area concerned and people within it, it isn’t worth the hassle

Kill em in season and get a Night Licence to be doubly effective

Land owner needs to put some higher fencing in above the existing wallings or fences for area affected
 
for what its worth, the place I hunt in Hungary when their neighbouring farmers have a problem with stags the hunt club just shoot at them with 12 bore loaded with 9 shot from quite a distance. The stags hear the bang and feel the shot but it doesnt penitrate and they dont like it so they eff off.
I know that the "experts" will be saying what if and what ever but they have been doing this for many years with no problems.
