We have had to put up with a judiciary which for years failed to impose any penalties at all on people brought before them even when caught in flagrante.From the safety of the bench they they made pointed remarks about 'landlords' and carried on supporting the notion of 'one for the pot' even when faced with evidence of commercial scale activity. There was little incentive for the Wildlife Service or Garda to prosecute.
Two friends of mine challenged a gang in Wicklow some years ago and received a severe beating up for their pains.
In recent years the only way to get the Garda to take interest was if there was threatening behaviour with firearms.
In the case quoted in the post, presumably after the guilty finding their previous record , if any, was brought up. This may have had a bearing on the punishment inflicted. Unless the judge was a particularly loose cannon he would not have imposed a penalty that was likely to be overturned on appeal.
