Hare coursers

After a traumatic 10 months of uncertainty, I write this short article in the hope to help others that finds themselves in unfortunate circumstances, like the one that I was forced into,and would like to make you aware of a specialist solicitor who achieved for us what no one could have thought possible.
I am the head gamekeeper on a Large Estate with a team of 4 Beat Keepers. In January 2020 we found ourselves involved with Trespassing Travellers who were Hare Coursing resulting in violence and the theft of a keepers shotgun which was then used to threaten us. I was left with no other option than to try and regain control of the firearm which resulted ina struggle and it being accidentally discharged, leaving another hare courser injured.
While the Hare Coursers fled the scene we remained, beaten and bloody, for the Police to arrive. Later, several hare coursers were arrested due to one visiting the hospital with his shotgun injury. However, they claimed they were the victims,leaving us as the criminals. We were all arrested for several offences including Affray (public order), ABH, GBH and Possession of a firearm with intent to cause fear of violence. This became a nightmare and not knowing where to begin we sought legal advice, which we followed, from a recommended solicitor, Laura Saunsbury from Lewis Nedas Law, who is a leading expert in Firearms Law. Laura is a consultant solicitor with 25 years experience practicing exclusively in firearms related law, both criminal offences and firearms licensing appeals.
We were all facing a lengthy court battle and were at serious risk of losing our shotgun/firearm certificates, lively-hoods, and for my-self more than likely a prison sentence, but with Laura taking the lead role thanks to her expertise we all received a ‘no further action’ result, and had our certificates/firearms returned within weeks of the outcome.
We were all worried about the process of being charged and put on trial, especially having to give our version of events in a court against travellers. However, I can’t emphasise enough how much time and effort that Laura put into our case, every action and letter was done with consideration and at no point did any of us feel alone or let down.
Such like events are happening more and more up and down the countryside with disregard to common sense, but unfortunately there is a law and a legal process that needs to be followed.
I hope never to find myself in this position again but wanted to make others aware that bad things happen out of our control but with the right legal guidance the correct outcome will be achieved.
I have since bought Laura’s book,’ The Firearms Law Handbook’, which I was unaware of.
I have attached the link as I find it very interesting, factualand easy to understand. In my opinion this book is a must for anyone who holds a firearm/shotgun certificate.

all I can say is WELL DONE. And hopefully you never have to face this kind of situation again.
 
What a nightmare for you sounds like Laura was the saviour best of luck putting that behind you. Will have a look at that handbook not until you have such events do your realise what you do not know
 
What a dreadful experience but well done to you and your team and of course Laura for enduring and coming through it. A timely warning for any of us involved in countryside sports. 🐕🐕
 
Christ what a hell of a situation! Glad to hear justice was served for you and your team. However, did the police prosecute the vermin who had stolen the firearm? Or was it a one way street?

Glad you got the correct result. Can’t bare to think of what you have all been through, not forgetting your family and close friends. The vermin will no doubt be out and about doing what they think is there god forbidden right and carrying on trespassing !!!!
 
Jeez, sounds terrifying and traumatic. Must admit, being physically unarmed is one of my biggest fears and why I always look behind me regularly while alone in the woods.

Well done, and thanks for writing this, we suffer with travellers lamping the birds and ground game every other week. It’s always the old adage that we don’t know where they live but they certainly know where we are. But I certainly hope never to be in your situation. All the best
 
Isn’t it funny that those of us with residential addresses, good records of paying tax and extensive history of good behaviour are the first to be arrested. Could it be that the Police know that the others involved are ‘too difficult’ to prosecute so they take the easy route to allow them to achieve their arrest/charging stats?
 
Well done msb, increasingly, keepers and other custodians of the countryside are coming under threat from a variety of sources. More often than bot they are portrayed as the bad guys which just isn't true.

It is certainly the case that those of an "itinerant" lifestyle are challenging to bring to book.

It is most certainly not the case that the Police "take the easy route" in arresting others to achieve "arrest/charging stats".
No such stats. exist and no right minded individual would subscribe to such nonsense.
 
Well done. Comes at a time here in Lincolnshire where we are having massive problems with courses. Travelling miles to get here and causing mayhem. Something has to be done soon. All my farmer friends can do is keep reporting them and hope more can be done by the Police.
 
What a relief for you all. Another good reason to record every altercation. Poor traveller getting injured. 😭

A gang of trespassers illegally hunting are confronted, they react violently, commit assault, steal a shotgun and use it to intimidate and threaten its registered owner, when an attempt to recover the firearm is made, there is a struggle and the firearm is discharged, resulting in injury to one of the trespassers and when the police respond they initiate multiple criminal prosecutions against the injured party?
Sorry, but that’s just crazy and a complete reversal of what should have happened. I’d go so far as to say its illogical, contrary to natural justice and an abuse of both the law and police power.
I think I’d be looking for a formal apology at the very least

Abuse of law and police power? Really.
Im afraid that is how the legal system works as the police were not there to witness the entire event.
Thankfully, the OP eventually got the deserved result but the travellers were arrested and made counter allegations.
The correct process was adopted by the police and the matter was reported to the Court for them to hear the evidence and decide innocence or guilt.
Thats how the system works.
Thankfully, it appears that through the good work of the solicitor involved, the "star witnesses" evidential statements have been scrutinised and they have been exposed for what they are and the matter did not get as far as going to Court.
So what process should have happened?
