If you are correct and you started making them first. It's time to ask for a list of their customers and for them to stop making it.

Not a good idea. The legal costs would be prohibitive, and "if" he can prove his case, better off to tell them to stick it, and get on with all the knives, people want him to make.

I do hope he takes legal advice though.

If a company was ever short sighted, it's Emberleaf. They have stated the Green Man Forge knife is the same as theirs, whilst they are charging 3 times the price for the same knife :-|


I suspect they will bitterly regret their actions !
 
There is no way this is ever going anywhere. Solicitors letters mean nothing... I’m afraid it would cost a lot of money on both sides to go through the courts. If it were me I’d ignore it it’s utter nonsense regardless of true or not unless you have 100k to prove or disprove anything. Trust me I’ve been there

scrolled through well over a hundred comments on the FB post and couldn’t see anything from Emberleaf. what’s their stance on this?

I own an emberleaf and this has certainly left a nasty taste!

I am writing this on behalf of Emberleaf just to clear up some points, last year we were in the process of building a new range of knives for a larger dealer of ours which would include their logo, as such they asked us to provide intellectual property rights documents for all the shapes they were to stock, one of which was the Cael V2, So we set about it and registered all the new shapes and the Cael along with them even though the Cael wasn’t a new knife in our range as we have been making it for some years, it was more a box ticking exercise. It is registered with the Intellectual property office number: 6070123 While this process was going on and the paperwork already filed, we were made aware of Green man forge, until then had never heard of him or seen any of his work. So a knife arrived in the post with a strongly worded letter stating that it had failed and we should put it right under our life time warranty terms, Only it wasn’t one of ours, we explained this over a long rather heated conversation, I have no idea how he came to believe it was ours perhaps bought second hand but it had no box, no paper work and was badly damaged and in the end we did actually put it right for a small fee, new edge new sheath and it was as good as we could make it. As you may have guessed it was a Greenman stalking knife. Shortly after that a customer informed us they took it upon themselves to message Greenman forge via Instagram I believe, and having pointed out the knives were very similar were met with some minor abuse and a rant about how Emberleaf do not make our knives in house and its all fakery etc… It was after this it was clear that Emberleaf approaching Greenman directly would be a mistake as emotions seemed to be running high. We contacted Briffa a specialist in Intellectual property and copy right law and the result is the above letter, I want to make it clear this is the only legal letter we have sent anyone, we have had quiet conversations about copies with other makers but never has it gone as far as this as we felt we were unable to have the type of conversation required to resolve it. We did our homework and would not have gone down this road without good cause. There exists no where online any image or mention of the Green man stalker before July 2018 which is a facebook post, where are the other images of this knife on facebook since the page was created in 2014? The Greenman forge as a limited company has only existed since Oct 2017 so filed records are hard to come by. Is the logic really that we saw a shape copied it spent 10s of thousands of pounds on R+D and marketing for us then to try and take legal action against the person we are supposed to have copied it from? We are not a big company, there are 3 of us including the apprentice, we just want to get on and do the job we love, however we have not just our own brand to consider but much larger companies that require us to at least to be seen to be protecting the designs and brand names. I am deeply sorry for all the hate and issues this has caused, but we are only acting in the best interest of our business, its members, and our customers. Thank you for your time. I can't see it either Mike L Ihave looked at the post and selected all comments and read it the FACTs are detailed in the photos of the letters from the solicitor :thumb:
