Yep I understand. He’s had £450 off me in good faith.
The jerk who tried to rip me off on Ebay only owed me £30 but was too thick to understand I wouldn’t give up and I happily spent about another £100+ to recover my money. I got it all back because I was in the position to pay for a County Court Judgment and subsequent Warrant . I will do just the same with this guy , the difference is that he may liquidate his poxy Company without any assets having spent our money on his guitar collection. We shall see.
Just a thought. You need to check on the exact details. However it is possible that he has taken money from the company illegally. It is to do with solvency and dividends. HMRC don’t take kindly to you taking illegal dividends ie you can’t take all the cash out then go bust. You might not get your cash but if HMRC decide that he’s taken money he shouldn’t. The penalty is usually to repay the dividends. With the same amount again as a fine.
 
Thanks for the information, we will know more after the 24 January deadline to respond has passed. Who knows, perhaps he will decide to repay the money he took from us. Cheers, shoot straight
 
Hi all I ordered 2 knives of Jeff last Jan. still waiting for them and have been asking him where they are since august. Asked for a refund just before Christmas’s but he said no. Have just sent another msg saying I either get a refund or I will go to small claim courts. I had paid him £280. Wish I never had ordered off him now.

Hi Tom Jarvis, I see you managed to message him just before Christmas and get a reply what means did you use, I have had no response from him.
 
I wonder what effect it would have if all those who have paid for knives. Went to the police and reported him? If he has no intention of supplying said knives (and the closing of Facebook etc accounts would imply he doesn’t) then is it not fraud of some degree? Trading standards maybe?
If it were me I would be applying all the pressure I could by all legal means.

You can see in this listing it signed Jeff and looks like he's clearing out his shop looking at the other listings


 
And checking eBay for the other items for sale he/they are also disposing of the contents of the shop in Otley
Appears so it says in one of the listings aswell that they are selling stuff as no longer have space due to them closing the shop after Xmas

But you could try contacting via eBay allthough am sure you will get blocked

Am sure he is shitting himself as everytime he removes a point of contact another way is found to contact him

HMRC would no doubt take an interest. Because unless he’s putting said monies into the business account and paying his debts. He’s treading on very shaky ground. HMRC have more powers (in certain areas) than the police.
You break the law by trading insolvent. Something which many businesses do on a daily basis (run with an overdraft paying it off monthly etc).
You might not get your money back because HMRC and then banks are going to be first in the queue. However you might get the satisfaction that he hasn’t profited from it.
The legal protection of being a limited company does not extend to you personally if you take money from the business you shouldn’t have done. So potentially he’ll have to pay it back.
I know it’s not what people want to hear (that they might not see a penny back) but I would prefer he didn’t gain, even if the tax man took it.
Personally I would report him to the police (they may or may not be interested)
Trading Standards (they should be interested)
HMRC hopefully they will show an interest.
