No-one has asked about the boy?
or WHY the Police would change their tack and remove firearms from the "mentor"
have his parents or guardians applied pressure or suggested a civil follow up to the incident?
On the whole if the Police do not think a criminal offence has been committed then their involvement in the matter ends.
They obviously feel there is mileage in pursuing it or they wouldn't get into the operational and paperwork mountain that is likely to be involved in getting an ARU raid signed off and firearms seized and stored.
Someone has a real hard on for this if they think there is a case worth pursuing on the ability to loan a shotgun to non SGC holder dependant on permission vs. occupier status
Questions I would ask of any FEO when faced with these:
1/ Do you have the sporting rights what's the land the issue over?
Ask them to define this question
Rights are not given, permission is. by asking do you "have"...... the FEO is implying "own"
Are you asking if I OWN the sporting rights?
2/ Are you a member of the syndicate the shoots over the land?
"The" syndicate? Using the definitive article implies the FEO knows there is a specific syndicate in place.
I find that an odd question given he has asked no.1
3/ Are you the landowners agent? define "agent?" acting on behalf of the owner?
4/ Are you employed by the landowner? do you mean a paid employee?
arguably anyone carrying out work or activity on behalf of the owner, in this case pest control under the terms of the general license and receiving payment in the form of pigeons (which could then be sold) could be deemed an employee!!
has he asked the landowner these questions?
It is the landowner that could also be dragged into any civil action as by default the accident happened on their land.
Grey areas are in your favour
It means they are grey for the other side too!!
I agree accidents happen..but...... without knowing how competent the boys were, the details of the area they were sitting etc etc....
....would I leave a loaded shotgun standing muzzle up and allow someone else's child pick it up, even if I was sitting right next to them?
NO!!!
so many things that can and clearly did go wrong
"all the pheasants ever bred, (or in this case pigeons hit!)... won't account for one man dead"
