I’d be willing to bet no one has ever been convicted of trying to illegally obtain a firearm by putting a holding deposit on one while a variation goes through.
What CPS would imagine that the public would be best served chasing rubbish like that .

Possible not, but your FEO doesn't need to get a prosecution to remove your FAC. It could be the excuse they are looking for to revoke your ticket.
 
A while ago I had a similar situation to you and was given a temporary license and which I think they called a permit for disposal for my previous 243 which allowed me to keep it and have an open slot for the new one. From memory it was valid for 6 months but could be extended if needed.

I once offered to pay in full for a rifle until I could return with my FAC . I left it at home.
Shop said no, that would be selling it without seeing a FAC. So they accepted a deposit, full price less a fiver.

I left a deposit with a well respected gunshop, pending a variation..........I'm sure they would have refused if it was illegal.

If your feo is looking for an excuse to remove your fac you have more to worry about than paying a deposit

From personal experience I can say some are on a mission to reduce the number of FAC holders. I have had a "warning" based on the then FEO's opinion (an unfounded one at that) and it caused me a lot of hassle trying to prove a negative. I have had them lie to my land owners when checking land, so forgive me if I work on the basis of not giving them any reason to cause me any problems.
