I highly recommend you talk that through very carefully with a good legally trained person before risking a trial, if you are ever in such a situation. "Not in the public interest " is a big question mark . I do side with you that the CPS likely wont go for it , its just the stakes are high , it is possible to keep your FAC with a caution on record

Well I shall follow that advice the next time I look in my shaving mirror. I don't accept it would go to trial, there are several options to this senario

Let's not forget that the OP was on a motorbike - wheel braces, hammers etc. might be a stretch.

It's a shame you folks in Britland can't carry knives with a lock, but I'm afraid I'd prefer to feel bad about the deer out of jail i that situation. In the car - a hammer would be my preference.

Which is exactly where the OP was at the start of this thread, but I've got doubts that it would work.

Perhaps not.

It depends on the circumstances.

I work as a Gamekeeper. I use it for work. The lock mechanism is a safety device. That is my 'reasonable excuse'.

A couple of 'issues' this year have limited my time outdoors, but I'm hoping to be back in the 'saddle' for next month and the arrival of the birds.

I very much hope the wee dog will be out on all the shoot days (only four), as will the old fella, but he is slowing down a bit, and will probably only come out for a couple of drives each day.

In answer to S62, we don't have very much "knife crime" here, so carrying without reasonable cause tends to be an add on charge after you have made an arse of yourself doing something that is an actual offense- assault etc.
I carry a lockblade pocket knife everywhere, but I also use it at work (engineering) constantly and live in a pretty rural town so don't expect to be challenged absent some major faux pas on my part.

I have killed a dog that was hit by a car, but did it with a wheel brace as I didn't have anything better to hand. Nowadays I have a 4lb hammer as part of the Landcruiser recovery toolkit, and that would be my first option unless I was carrying a firearm and it was safe to use it.

Regardless of what I had, I'd make as sure as possible no cameras were around. That sort of film could/would be misunderstood in a heartbeat out on the interwebz.
 
No knife, find a big stick or similar and try to knock its head off with one blow. You will not knock its head off of course but no point giving it a tap, hit it like you mean it. Back of head around ear height.
 
Well done to the OP for stopping- I feel that was very much the right thing to do, without delay, without waiting hours for someone authorised to turn up with a rifle.

Its a scenario I always think about as we have so many deer hit near us, I've had a few near misses during the fallow rut.

I have mentally prepared and would certainly use a knife (glove box) over a hammer/stick. Always have a few old dog towels / blankets in the boot of the car which might be useful to use as a shield or for any mess...

And definitely make sure no t**t is filming...
 
I had to dispatch one the other week. Was driving past to look round a farm up the road. Spotted police car in one of gateways. Then spotted roe buck lying in the gateway. Bizzarely enough I knew one of the officers and I have permission on farm so no difficulty.
I do feel sorry for the police who have these call outs. Because it is a hard job for them. With no quick fix
 
Interesting debate, road accidents involving fallow round here are relatively commonplace (5mins from J28 M25), never come across a wounded deer, although some years ago my father hit a fox and dint kill it. after leaving my house. Came back five mins later asking me to put it out of its misery.

At that time i held a SGC, but given it was a public place that wasn't an option i considered. 16oz claw hammer to the top of the head did the job very quickly and relatively cleanly, as someone else said, don't tap it, hit it like you mean it and it will expire about as instantly as being shot in the head with your hunting rifle i believe..

Not sure id take the same approach with a deer carrying antlers though.
 
There was something in the press a couple of weeks ago about a man (I think a farm worker) who was stopped by the police on an unrelated matter for which no charges were brought who was then charged as he had a folding knife on him in the street.

I know there was something similar a couple of years ago with another farm worker who was spotted in a shop buying his lunch with a knife on his belt.

I would not keep a locking knife or fixed bladed knife with me unless I was actually using it though. Just an argument I can do without and I really can’t see it getting any easier.
 
Resurrecting an old thread here but reminded of an incident that happened to me about 30 years ago. I was travelling by motorcycle on my usual 60 mile commute and came across a freshly killed roe doe by the side of the road. I discreetly gralloched the beast (Swiss army knife) and hid it, it was the middle of winter so no worry about spoilage. On my way home I stopped and wrapped it in bin bags then strapped it to the back of the bike and rode home. When I stopped at home I realised that one side of the bike and my left leg were absolutely, I mean completely, covered in blood. No idea what other road users thought but nobody approached me! From memory it ate well. 😁

I recall a few years back heading to work and halfway there seeing a couple of cars parked up half on road and half on verge, I assumed RTA. However as I went passed I could see a good size Fallow Buck thrashing around on the verge it had obviously been hit. I didn’t stop as in a suite and tie and no knife in the car thinking “ well what could I do” by the time I got to work I felt properly bad about it but in reality what would/could I have done
