Help: UK E bay seller refusing to honour products 3 yr warranty

Consumer Rights Act. Google that.

Your contract is with the seller. Sue them. There is what is called the Simple Procedure which kind of replaces the Small Claims Court.
I had this, seller objected so it went before a (refuse to call him a judge) 🤡 in court - thats another day of your life gone, armed with quotes of rules and regulations I went.... judge didn't know anything about the consumer rights act 🙄 he was only there to 'reach an agreement' which was not acceptable to me after the sellers behaviour, so I took my things and left the room.
Just my personal experience but have since heard similar stories.

Only the very rich can afford proper justice via the legal system.
 
for £50 you're wasting your time pursuing this extensively. Based on the sellers response you're not going to get anywhere unless taking them to claims court, which to be frank, isn't going to be worth the hassle.
This 100%, you have had it and used it for a couple of years, even if you had to return it then they will claim you got it wet or dropped it. I presume you looked at the manufacturers T&C's for registering it for warranty support ?
Call them instead, you have nothing to lose.
 
Looking at the sellers site and the T&C's as quoted (on Ebay) and below, I wouldn't personally buy anything from them, especially after reading item 1 in the returns section, one clue is the grammar of the T&C's, which is always a give away.

RETURNS
1. If you receive a faulty item or change your mind, simply return it within 7 days for an exchanging the right one product. After that, no return and refund will be accepted.
2. The buyer is responsible for all postal cost incurred for any item/s which is returned in all circumstances.
3. If you have any query regarding a product please contact us via the eBay email system. We are not responsible if you contact us with an alternative email address.
4. Return items must have all original condition, packing, and accessories.
5. Return postage and insurance charges are non-refundable for items.
6. If the items are returned unused but packaging opened, that we cannot accept the returns due to Health and Safety reasons.

Regarding a Money Back Guarantee from Paypal, their T&C's state they will give a refund if.... the goods are not as advertised, as you have had and used the Item for 2 years(almost), I doubt they will help you, to me and no doubt many others, buying off Ebay is a risk, most of the warranties given are worthless, as so many of these adverts are from Chinese Firms, who will insist you send the item back to China, I know yours was, as far as you can tell not from China but off a firm in London, you have to be very careful nowadays buying online from anyone, no one seems interested when things go wrong, you only have to look at the response to Scammers, they always blame the person scammed, although it is obvious they must be able to trace the money that the scammers have goyt away with.
Good Luck on your Quest for compensation, but I wouldn't hold out too much for getting it.
 
damage limitation on your time and stress levels, bin it and a buy one from reputable dealer
lives toooo short to be chasing someone for £50.00 you’ve had the use of it for a couple years
 
I had similar with a pair of defender headlights, listed as 5 year warranty ip67 rated and waterproof, 1 Welsh lake and they were full. Ebay we're useless and closed the complaint because it was over 12 months old no matter what the advert said but PayPal were brilliant, 10 minute phone call and an instant refund

Ebay have a "report problem with seller" process.
I'd report your concern to ebay and then contact PayPal for a refund.
Be sure to get some screen shots of 3yr guarantee

If new goods then. more and more, such as bike tyres and etc. I now check on Amazon to see if what I'm looking at on eBay may also be listed there by other businesses.

amazing how many times people buy from eBay and amazon deliver directly to them.... must have been cheaper on there if they had looked
 
it is always best to have paid by credit card via PayPal... that way you have the 'not of merchantable quality ' option via your credit card even after a period of time

one of my customers sell on amazon. he has found an eday listing of his item at increased price. all the ebay seller does is make money on an email, with no come back on him
 
In December 2020 my son brought me an on balance carat scale from UK seller camden_market_place

It was advertised as having a 3 year warranty.

I use it for weighing powder and up till last month it worked faultlessly. However it stopped working and having replaced the batteries x3 it still will not turn on.

THEY STILL STOCK AND SELL THE SAME BALANCE.

First response from them was its over 2 yrs old and wont repair or replace.

Strange as it was purchased 29/12/2020 so not yet 24 months old!

Son pointed out its listed on their sellers page as having 3 year warranty.

Their reply: As I said, long time has passed,So, I can't help to you, but you can contact the company.

Son paid by PayPal so may be able to get a refund but it will be a tedious process.

Point is I need an electronic balance and I am dammed if I should shell out another £50.

What are my rights? If need be I am minded to take it to the small claims court.

I have know idea who the UK importer is.

Also no name for the owner of the ebay shop but there is an address.

Whats the SD collective view on how best to resolve this?

You bought a £50 scale and you’ve had 2 years trouble free use from it. You’ve done alright. Buy another one and save yourself a headache.

You may need to check the fine print to confirm if the three year warranty is not specifically a manufacturer's warranty and so you end up dealing with the manufacturer to get it repaired or replaced if it is deemed to have failed after its expected service life.

Your statutory rights are in place during the life expectancy of the product. An electronic scale at £50 could be argued to be at the cheaper end so about two years is expected (Zeiss only give a two year warranty on the electronics in their £650 range finder). It is down to you to prove the product suffered a manufacturing defect and is eligible to be replaced/refunded under warranty rather than general wear and tear.
 
Ignore electronics. Buy a balance beam scale, learn how to read a vernier scale, and even a basic Lee one will still be useful to your grand children long after you are gone.

I contacted on balance and had a reply from the customer services team at Dhiman Enterprises LTD. They contacted the Ebay seller and told them in no uncertain terms that they had to replace my unit. Needless to say no joy. They then sent me the sellers phone no, but repeated calls not answered. I returned my defective scales signed for. Took 4 attempts to make delivery. That was end of Jan. Contacted Dhiman again who sent another v strongly worded email to seller. Guess what at the weekend my son found a ebay packet hidden under his bike cover. Inside new balance, no delivery/dispatch paperwork absolutely nothing. So happy days and have registered it on the OnBalance web site so now has 10 yrs warranty.

I am just taken aback by the arrogance of Camden-market-place as in the returned packet I included my address and asked them to email me when they shipped the replacement, wasted my time.

So SD members to the rescue, many thanks

Excellent news, it was a long shot but like I said you had nothing to lose and infact you gained some new scales :)

It may only be £50 but if we let eBay scammers get away with it then it just encourages them to continue their shitty “business practices” with other customers.
Avoid eBay Amazon etc.
