The wording you provided is, "a suitable dog should be available". Legally, should carries no obligation. It is more a suggestion or recommendation. Must or shall are used to convey a mandatory obligation.
There is no doubt it would be best practice to have access to a dog, but that clause does not make it a legal necessity.
 
Read post #162. Note the word MUST. Also note that it’s a condition or the license.
It’s where it gets difficult to some.

You MUST follow GUIDLINES that are not rigid and open to some interpretation.
Phrases like “ideally” does not mean mandated.

At the end of the day if you choose to shoot deer on the edge of thick cover or in woods at night you are asking for trouble. I have little doubt someone will which is why I guess they have put this in,

I think you will find that when the DI was disbanded all its funds and the name was taken over by the BDS.

I just read the DI best practice linked from the Gov site, so it states heart/lung shot, considering the amount of deer that will be delivered to some game dealers (not mine as they quite rightly don't penalise the stalker for boiler room shots)they will not be happy with this influx.

Thanks for this, I wasn't aware, I was kind of suspicious of what occurred, that clears it up, I thought they had been disbanded and gone. That explains a lot.

It did get announced at the time:


However this was all happening at the time that the UK moved into the Covid lockdowns, so largely got lost in the noise. Also it was easy to mistake DI Ltd and the DI Partnership as one and the same.

Whilst CL55 represents the collective view of all the members of the DI Partnership, the re-writing of the Best Practice Guide on night shooting was led by BASC, in conjunction with Natural England:

I did have my suspicions that the DI were still active and up to their usual tricks but didn’t realise they still existed as an entity.
My bad.
 
When there may be someone in the next field shooting foxes or rabbits who has given the police no notice at all it seems jobsworthy to have to notify before every visit at least 24 hrs in advance.
The whole location requirement also becomes slightly farcical if you might be operating on a large estate that could be 15km long and spread between two counties. 😅
 
Why have NE not got simplified land parcel numbers ,and a control to notify like other night cull schemes may have had?
Everyone's facs and vehicles were recorded prior.

that's not what it says (but probably the intent!). It just says you have to inform at least 24hrs in advance of shooting. There is no maximum notice period so my intention for next season is to inform the local police that "Night shooting in accordance with CL55 will take place on XXXX site between the period of 1st August and 30th April".
