Moderators off ticket tomorrow then ..

We are constantly fighting an uphill battle as firearms owners though, so i will welcome any victory for common sense with enthusiasm.
So that's two small victories for shooters now (expanding ammunition and sound moderators). Though the arguments reined on for many long years before common sense finally prevailed.
 
It will always take a wee while for directives to flow individuals on the front line and for change in procedures to be enacted.

If you read the home office directive as posted in 123 above all the questions regarding moderators for section 1 and for shotguns and air rifles becomes clear.

You do NOT need an FAC or SC to possess a moderator for an air rifle. However if you use it on a section 1 firearm and do not have appropriate license for such a firearm you are committing an offence.

As with any new UK legislation it will take time for a body of case law to be built up to determine how the courts deal with all the various ramifications of the new law.

I am sure that sooner or later someone will try to claim that a DPT Modular Non Magnum Centrefire Moderator is for an air rifle and thus he doesn’t need an FAC to possess it.

Even if all the markings are stampings are removed, simple measurements and comparison will soon clarify the matter. I suspect the defence would fail before the courts.

I think they could (and should!) have taken the opportunity to fix a situation whereby if you are in possession of a moderator or flash hider without either an air rifle or a firearms certificate it potentially exposes you to unacceptable risk. There was a case (R vs Yong, IIRC) where a person had a flash hider which he claimed was for an airsoft pistol (amongst a sea of other things he shouldn't have had). They decided not to prosecute him on any of the other bits but prosecuted him for the flash hider and he was convicted. On appeal, the conviction was upheld with the upshot being that in future it will be up to the defence to argue that such "dual use" should be put before a jury for them to find on the facts of the case. They didn't make that argument at the time, so the appeal failed.
 
I find it super unusual that they effectively decided too remove them from tickets overnight Is that not strange? I know we all knew It was coming, but I would of expected it too follow the changes Scotland seen in 2023 for ammunition restrictions and seasons and thermal imaging where It was informed a few months ahead, some changes separated by a month or so.

Now Is just a bunch of confusion between forces RDF's & people?
 
It isn't really confusing. Basically the police service don't tend to jump until the the HO circular comes out.

The NPCC has known since Royal Assent to the Bill that it was coming and that there would be a HO circular. Simon Chesterman is, I think still the firearms lead for them, and really his staff officer could have been proactive about this to find out when the circular was coming and do some internal comms.

Policing is often a reactive service - and is generally very good at that - but often lets itself down on proactivity...... usually caused by having to spin too many plates at once and having to prioritise.

I don't think this will have been a priority for NPCC. May be a big thing for the shooting community but pretty inconsequential in the grand scheme of things for UK policing.

I suspect they will get their act together now the circular is out there.
