I have some small experience of the law.
just checking , so do i therefore i realise the importance the use of test cases in a defence or the failure of a defence . There was more new laws made during the Blair government than all laws previously made from the date of the magnacarta. If that doesn't Scare a man ....
 
frankly i dont know but i do know shotgun can be fired from the road but not sure i would want to end up in court because enough folks have been convicted of things that where not actually against the law . A lot of laws get changed unless its your trade its thin ice
I think this is an argument in favour of knowing what the law actually says, and acting accordingly.
Of course if it ain't something you need to do, it doesn't matter - but stating categorically that is unlawful (post 2) and then subsequently saying that you've actually don't know is perhaps not very helpful to the OP?

If that doesn't Scare a man ....
It could either scare a man into doing nothing in case he breaks a law, or scare him into finding out what the law actually says and acting accordingly.

I'm for the latter course.

You are asking the wrong question to the wrong people….. What you SHOULD do is ; Ask yourself….. “Self is shooting this fox worth possibly losing my FAC over?”

I'll get a definitive answer but I'm almost certain that in Scotland it is lawful to shoot from a road, on top of (say) a car bonnet as long as no one is inconvenienced. That's a pretty broad spectrum of 'inconvenienced' but my understanding would be no-one having to stop for you to complete the shot or being frightened/distressed by seeing a man (presumably) with a gun in the road etc which could be a breach of the peace -that's an almost certain certificate revocation.
The A9 cowboys will be ecstatic .
 
Thought in Englandshire you could shoot from from public highway providing you had sporting rights to both sides of road and did not endanger other road users in doing so, but this was mid eighties and tested I believe, in Scotland have no idea but shot plenty in remote areas in middle of night by pulling off road side to shoot where possible.
 
Many parts of the Yorkshire Dales are shot by keepers in darkness doing there work from single lane public tarmac roads, cutting through open estate ground for many miles.
You would be lucky to count more fingers on one hand than vehicles traveling these roads during the night, most of these probably associated with the farms and estates.
This is where the common sense has to rule surely, no need for even grey areas.
 
I thought the following:

It is forbidden to shoot from a public highway or verge in England and Wales – and although shooting from a public highway is not forbidden in Scotland, reckless discharge would be committed under common law if a member of the public was inconvenienced or disturbed as the result of a shot.
You will see it happening all over rural Wales. I'm not aware of anyone that has ever been pulled up over it.

Was pulled over mid eighties Yorkshire dales by non local speed cop who insisted I was in the wrong, advice sought told to continue as normal and did.
