All mitigating circumstances one way or another, and I can pretty be sure to say someone doing 4mph over the limit would not get hammered unless it was a repeat thing,That’s a bad decision though - as you said, raining and he was overtaking…I agree with people being prosecuted if they are making poor decisions, but on a dry summers day with good visibility and a roadworthy vehicle hammering someone for 4mph above the limit seems silly.

Hence speed awareness courses, and the unlimited people I know who have had a word in their ear and told to slow down with no further action taken
