Without trying to bore anyone, The rationale for the Proceeds of Crime Act (POCA) does not seem to be generally well understood.
The PC, as anyone, who has legitimately paid into a pension pot has done do lawfully so the pension will not be subject of the POCA. Had the pension contribution come about as a direct result of crime(s) then arguably it could be subject to the POCA.
As for the question of whether it is a crime to buy a car or a home, simply no. However if the money used to purchase said goods is stolen or the consequence of crime(s) then the purchase transaction would still be lawful but the purchased products could be seized under the POCA, let’s not get into other legislation, as they came about as a result of crime(s). There would also be remedies under contract law.
I really need to get more exciting interests.
