Possible fraud has anyone else dealt with this chap.

Unfortunately he lives in Ireland and I am over 70, the last fight I had was 67 years ago we were both about 12, so that is out of the question.
Probably not worth paying for a ferry to be honest.

For the record, I was in no way, shape or form suggesting that I’d go to their house and fight them.

I’d go and ask for it back and if they didn’t give it to me, I’d call the police. These people do these scams because they’re anonymous. If you turn up at their house, they’ll realise that they aren’t as anonymous as they thought and might think twice in future. I wouldn’t expect that going to their house would get my scope back but I would certainly go and ask for it. Police are far more likely to attend if you’re stood in front of the scammer.

Maybe I just watched too much Cook Report in the eighties?
 
I told an Ebay blagger that if I did not receive what I purchased from him in the following five days, I would call on him, telling him I had figured out where he was by his stupid nom de plume that included some fine detail.
The item arrived next day by recorded delivery.o_O
 
EBay should hold the money until he has returned the item. EBay should not have issued a refund until the item was returned.

Are you sure that eBay have not just held the money until the scope is returned. If the scope is not returned no refund.

Unless of course you clicked that the scope had been returned resulting in the refund being issued and you having no scope.

Without names, no one will ever know if anyone has dealt with the person.
Surely (as you have quite rightly pointed out) the buyer should not have received a refund until the seller (OP) received the returned item?

I sold a scope £425 on .
Chap was not happy so started return.
EB refunded money he still has scope and refusing to send it to me.EB of course does not give a toss.

Has anyone else had similar experience.

I am contacting fraud office in 10 days if he still has my scope, and they are interested to know if he has been doing this before..

Presumably he has bought a rifle scope to sit on a rifle thus he is in possession of an FAC?

To be in possession of an FAC you must be a person of “good character”. This is not the behaviour of someone of good character. And I am sure the police force FLO under which he resides would look at such information with interest. I can foresee an interesting discussion at time of renewal, if not earlier.
 
Funnily enough it was a guy from Ireland that conned me too.
He wanted some 30-06 cases and gave me an address so I sent them and asked for payment on receipt, he said he never got them so didn't pay.
When I google Earthed the address it was a company building so suggested he asked around at his work place as they had been received by someone.
He maintained they hadn't been received so never did pay.
 
Italy was also notorious selling to via eBay as the Italian postal service never took a proof of delivery.

Canada was bad not because of that issue but because items would often remain "in bond" or anyway uncleared with Canadian Customs for two or three months.

Eventually I used the eBay "Block countries I don't sell to" facility to block first Italy and Canada and now everywhere except UK I've blocked as not selling to.

A shame as USA bidders paid well for Enfield related stuff. Especially manuals and the like. Very well.

But then eBay started charging their commission on the total paid including the postage paid by the buyer.

So in effect you were posting at a loss to you sending outside UK using a tracked service. As eBay rules required a tracked service.

As said now it's Holt's, Southam's, or locally with Sutton Hill Country Auctions or Churchgate Auctions or SD or P/Watch or not at all. Never now eBay unless collection and cash on collection.
 
In which case after 14 days open a money claim online. And, don’t forget, you can add the cost of making the claim to the amount you are trying to recover.

Once the 3rd party is notified they have 14 days to respond to the court. If they don’t respond within that time you request a judgement which is also done online & typically takes a couple of days. If it goes in your favour then the 3rd party will have a CCJ against them. You can then take that judgement to the High Court so you can get proper recovery agents to visit the guy & get back what’s owed.

Don’t, whatever you do, go around there yourself!

Edit: just seen he’s in Ireland - north or south? UK courts won’t be able to help you if he’s in Eire I don’t think.

if the CCJ is taken to the High Court then you can instruct high court bailiffs who are paid on performance. Their cost is added to the debt owed to you as a claimant & it’s in their interest to secure the payment. Unlike a County Court bailiff who gets paid regardless. Have had to use them a few times when clients have decided paying me was optional…

Unfortunately, OP will be limited to the County Court as the amount is below £600.

I must admit, 'High Court enforcement agents' does have a better ring to it in achieving the desired effect!

Title IS a little confusing, how would anyone know if they had prior dealings with an un named subject?:-|
If some one has been conned and they say he is from same area, we may have good chance of the fraud squad getting involved, with him having guns as well they won't like it as someone else has pointed out to me.

He has six days to return it then I will use all the great advice I have had one here.
