New FAC Refusal insurance

Hi community.

I am not seeking advice, be it legal or people's view, more personal insurance experience.

I was refused a new FAC due to a chronic illness, not life-threatening, but now classed as a disability. I have decided not to appeal on cost, and after speaking to the lovely FEO, I will re-apply next year with a plan in place. However, the disability is not going anywhere, and I might be refused again.

I wanted to see if people have much experience with BASC insurance covering medical refusals. I was a member of the NRA at the time of refusal, but NRA legal cover doesn't cover medical refusals (a bit daft, but that is their insurance).

Just want myself covered next time so that I have somewhere to go if in the event.

Unfortunately, I should think the fact you have already been refused once, will mean any future policy will not cover you.

You need to speak to the providers directly to discuss their terms and conditions.

Mat I ask what type of illness, or disability would preclude someone from being granted a FAC ?
 
I would suggest that if you are a BASC member then you speak directly to their firearms dept. the main reason that they got rid of the insurance cover was that a) they dealt with a vast majority of cases in house without needing legal insurance assistance, b) the cost off the excess was extremely excessive to BASC, c) only about 5 cases which they could not sort were thought to be worthy of progressing by the insurance legal team - they cannot work miracles.... if you are not deemed fit to hold a licence for good reason, then they cannot alter that fact. (This was how it was explained to me by the firearms team)
 
Best of luck, I'm not sure on what grounds they could refuse an FAC for a disability? Would have thought that ventures into discrimination. Definitely worth a call to BASC to ask for advice

I had spoken to them before posting, and on the phone, they were helpful. I just wanted to make sure I didn't end up as I have with the NRA not covering and that, from people's experience, they would support with legal assistance (inhouse or not).

It’s not a disability, it’s a condition, and if severe enough like other conditions could render you in a state when out with your firearm that you are not full control of it.

Same as someone who has seizures, they could be out, have a seizure and someone could walk by and take the firearm.

Thank you. It is slightly more complicated due to how migraines can affect people, such as some losing their sight. As such, if you are sat there with a loaded gun and you have a symptom that comes on quickly without warning, it may present an issue.

As such it is a case of proving for my situation this is not an issue is what needs to be done. The FEO didn't decline me it was above him. The FEO has given me advise but there is no garentees that the licensing manager won't decline me again.

Same as someone who has seizures, they could be out, have a seizure and someone could walk by and take the firearm.

I have had a couple of visual migraines where I have lost clear sight, most disturbing as I didn’t know what it was and on one occasion I was driving, it wasn’t instant more like a burning circle in the centre of my vision that radiated out.

Fortunately for me it’s only ever happened twice.

So what about driving then?
I informed DVLA and they wrote to GP and Neurology. Because I get warning signs with ample warning and that mine don't affect sight I have enough time to pull over to a safe location and wait it out. Due to those conditions I am allowed to continue driving. They did leave the proviso that is these circumstances changes then I have to inform them.

That sounds harsh from the police, I'd be fighting that, surely if you are out shooting and happen to feel a migraine come on, you put the gun down somewhere safe and secure and wait it out.

That is the case I would packup and lock the rifle in the car and then wait it out. I can still hire guns at the NRA and shoot. So the same would apply on that instance

They also said because it is a chronic illness they also feel that there is a higher chance of ending it with the rifle they issued based on their experience. Adding more reason for refusing.

What if you’ve walked 2 hours from your vehicle? Where is safe and secure?
