Last month I was at court for a house breaking (burglary in england) where the blood of the accused was found inside the house. He had never lived there, visited there or knew anyone there so how did his blood get there?
I can only assume he was responsible for the break in however the courts found him not guilty.
He clearly did and had the courts been allowed to look at his previous would have seen he was prolific at it.
Just because you are found not guilty of something it doesn't necessarily mean you didn't do it.
There are lots of loop holes and technicalities which allow people to walk free from court.
You are probably correct, but in my case the magistrates in the summing up said, "Domestic violence is traditionally associated with the male, but in this case the aggressor was clearly the female and that I had used the minimum appropriate restraint" - i.e gently holding on to her wrist and arm until she stopped drunkenly raining blows on me at the top of a steep flight of stairs, otherwise I would just have walked away from her as usual. Under examination she admitted to hitting me on various occaisions previously.
I would also point out that there wasn't a single mark or bruise on her, yet I was charged for assault by beating - all on her statement. According to my solicitor, much of it was lifted from a domestic abuse website. She was being dismissed from her job as a bank manager at the time and her behaviour had deteriorated badly towards me.
Around that time, her sister had been regularly calling the police on her ex-partner, against whom no charge was ever made. I can only assume she got the idea from her. I initially thought she had been arrested for drink driving and made up the allegations to get off. She did lose her job too. She subsequently has apologised for her actions on that night and regrets them.
I have been attacked by her on several occaisions over the years, the reason being she knows she is perfectly safe in doing so, as I would never raise a hand in anger to a woman. I can see how men could become victims of domestic violence. She a strong girl and rides horses.
When I left the court after the verdict, the prosecutor for the crown, smiled and said goodbye to me, which must mean something.....
I'm 43 years of age and have no criminal record whatsoever, not even driving convictions. All my ex girlfriends whom I still know offered to be character witnesses for me in court. Now I have my certs back, I'm going to start looking into the legality of me having actually being charged, entirely on heresay.
