Variation Problem. Beware!

This is interesting for me as I have a business which uses Firearms as well as my own private use weapons for my hobby.The Limited Company owns Firearms but has no FAC at all.Do the shareholders(of the Company) "own" those weapons?All of our Staff have there own individual FAC with the Companies Firearms listed on each Cert..........
 
reading this thread it seems that we are not alone in our authorities being unfamiliar with firearms ect, and blaming someone else, hope all goes well in the end.
 
The case law is plain and simple. The definition being, as in Sullivan v Caithness one of "proprietory possession".


If you pay for it then YOU HAVE PURCHASED IT. The relevant test is who now has title to the weapon. That is, if you drop dead, who owns the thing? The RFD? How can he you have paid him in full for it.

If you paid a deposit again the RFD is entitled to sue for performance of the contract if you then pull out.

The simple and clear way around this is to pay a nominal sum for an "option to purchase" at the stated sale price and that that "option to purchase" holds the weapon for you for a set number of days or weeks. That way there is no actual transfer of ownership but by accepting a nominal sum, £1.00 is enough, the RFD is legally bound to hold it for you until the time expires.
 
Today was a good news day.
First the FAC turned up along with a letter saying what I did was wrong, don't do it again, no further action. Copy of which stays with the police records of my SGC and FAC.

The FAC Variation for the 308 includes Deer, Foxes and any other vermin at the request of the landowner, AOLQ, Humane dispatch, animals posing a danger to other animals or humans which seems comprehensive to me and for which I say thank you.

On land deemed suitable by the Chief Officer.

So quickly signed it and went down to my RFD and collected my rifle :-D

I was home half an hour and my FEO rocks up on my doorstep with details of the farm which was 243 only now passed to 308 :lol:

Off to another dealer who had the Moderator in stock that I wanted :) and bought lots of other stuff as well and ended up with an empty wallet :doh:

Oh and sent a letter to the SD seller saying that the rifle was as desrcibed and I was very happy with it.
