Received email off Humberside police asking for Ā£47 because I’ve gone over the 7 days notice.,
I contacted BASC and they said yes this is correct
The guidance says 7 days or a reasonable time period the time period is left to the discretion of the individual force.
What 7-day notice?

There is no 7-day notice for applying for a 1-4-1. Point them to the Guidance (seen as Best Practice). Point this out to them and ask, politely, why they think it necessary to go against the Guidance.

HO Guidance on Firearms Law said:
ā€œOne for oneā€ variations

10.36 A variation is always necessary if a certificate holder wishes to change one of the firearms, even if they wish to purchase one identical to the one they are selling (Wilson v Coombe, Queen’s Bench Divisional Court, July 1988). ā€œOne for oneā€ variation refers to firearms that are authorised to be acquired following the disposal of a firearm or a request to change an existing authority to acquire. There is no set time in which the certificate holder must apply for a replacement authority once their firearm is disposed of. The keeping of open authorities indefinitely should be discouraged, subject to a collector seeking particular firearms. Applications for ā€œone for oneā€ variations should be made by the certificate holder submitting their firearm certificate together with a completed Form 201V to the police firearms licensing department. Such variations are processed free of charge. In most cases, it will not be necessary to re-examine the applicant’s circumstances. Further enquiries will be necessary, however, if for example the application is for a change of use or for a full-bore firearm when the holder’s shooting club only has facilities for small-bore shooting.

The reasonable time limit is there to stop one keeping a potential vacant slot open from one certificate to another after renewal.
BASC need to sort this out. Did you speak to the office or the legal team?

There is no 7-day notice for the 1-4-1. Certainly not an official one that I have seen in primary legislation or the Guidance.
There is a 7-day notice to tell them of a disposal.

If this is the new norm then as soon as you notify of disposal apply for another of the same straight away and then do a 1-4-1 later when you know what you want next.

All I want is a 1-4-1 variation and if I don’t have to pay that’s great.

What makes you think basc has any influence over fld.

as usual they interpret or ignore the HO guidance to our disadvantage, to challenge legally would cost more than the £47 fee for a variation.
But asking them in an email to respond as to why they feel the need to go against or ignore the Guidance is free.

Asking them to admit it in writing makes it a different ball game.

Apparently home office guidance can be interpreted by the individual forces some choose to charge others do not and Humberside is one force that chooses to charge

exactly its guidance not statutory law, so unlike us they ignore or interpret it how they like.

We can only look on, annoyed.
