Verbal permission when Shoot in Scotland with open ticket

Hi all, say for example if I was given verbal permission to shoot on someone's property and I knew where the boundaries were and everything was sound and the owner could confirm this if the police were ever investigating what it is that I was doing ...... would that be acceptable in Scotland on an open ticket or would you legally have to have it in writing?......have you ever had legal issues with this?
 
Verbal permission is all that’s required anywhere, unless you are shooting on land where the sporting rights are held separately from land ownership, in which case you would have to produce written evidence of permission if challenged by the landowner.

Home office guidance allows for informal and verbal permissions. Scotland probably fine, Hampshire enjoy the nightmare!
 
Is there anything in black and white that I can print off......Just incase someone challenges me, it could help defuse a situation where someone is poking there nose in my business

I always text my landowners prior to me visiting, they reply with an Ok 👍. Permission is up to date. Not a 10 yr old scrape of paper- current phone number also available if they insist on speaking to landowners.

What I meant was something in black and white confirming that verbal permission is ok.......one of my permissions is 82 and has full mental capacity but doesn't own a phone

In those circumstances I would probably want physically written permission in case another member of family intervenes and withdraws permission whilst you on are on ground- as unless you visit them on route to ground you dont know current capacity at that age if no phones
 
I do not believe that it makes any difference whether it's Scotland or otherwise, there is no legal requirement to have your permission in writing from the landowner of owner of the sporting rights, even the BASC pro-forma makes note of this.

That said, all permissions and grantors are different and depending on specific circumstances it might be wise to have the relevant information to hand if you are challenged by the authorities but again, it's not an actual legal requirement. For example, my main permission does not and did not want to get into all that, he had me sussed out as being a "grown up and sensible kinda bloke", his words not mine, and should I have any grief just give them his phone number. So far no grief and in fact, quite the opposite!
 
If you are in Scotland, Police Scotland have a sheet that shows owner details, your details and the land you shoot and what quarry allowed. Also has land owner and your signatures so removes any doubt if the situation arose and you had to prove its your shooting ground.

In law, for this is what you have an agreement, certainly in England and Wales verbal or written the agreement is equally as valid.

We make many verbal agreements every day in our lives. For example for the last three weeks and the next two weeks my neighbour is having their garden landscaped. Slabbed I call it. Landscaped they call it. So that the builder can get access they have asked if they can park their two cars on my hardstanding at the front of my house. I have said they can. That is a verbal agreement the same as the OP has.

Years ago when I had my land and my pond I allowed a friend to shoot the duck. I never really enjoyed duck shooting then and still don't now. Even those these were truly wild duck. That permission was never written down. It was a verbal agreement and the tenant was told of it so that if he saw someone called XXX and his dog shooting the duck he knew that he was there with my permission.

No legal requirement.

But a very useful thing to have. Can save you an awful lot of hassle.

I’ve also discovered that asking for it in writing frequently causes landowners to suddenly remember who else they’ve given permission too…

Here you go, had to "Rake Aboot" for it through emails from 2021 but this is the form Police Scotland had. Doesn't seem to be in use on the website anymore. But a well structured form. I don't give the details to Police Scotland but a handy form to have filled in if they turn up at whatever field you are in.
