If what you want are your firearms back and you are in the clear I would suggest forgetting about suing anyone for now and try to set up a meeting with them. If there has been some confusion with them then I suspect you are more likely to get through it by holding a sensible conversation with them rather than by suing them. Ultimately you have that option in the end. Bearing in mind that it is up to the Chief Constable to decide if you are a "fit" character then I'm guessing accusing them of all sorts and then suing them may not be very persuasive from his point of view. We have no right to hold arms it is a priveledge and like it or lump it it is one that is extended by the Police.

the one thing that stands out in all of this!!... is the fact that Brit had most items taken that can!!...be legally,.. bought by anyone anywhere without a licence!!..books,bayonets,powders (not black powder!) wooden rifle stocks..even:shock:....now then isn't this stupid or what??...Brit could simply walk/drive to his nearest shop and buy/replace these items!!...so no public safety issues with brit then!!..so why take them??:suss:
 
Had my rifles, shotguns, ammo all removed because ex complained to her lawyer about our divorce proceedings and the arguments we had, lawyer contacts plod and hay hoe all my stuff taken no receipts anything, I was lucky as I knew the policeman and he told me no problems will get all my stuff back, well it took 6 months and a court case to be told no case to answer for. I was in a low paid job at the time and got legal aid, my lawyer was a shooting man and knew the score.

Last sentence by shootingdog... is actually incorrect, we have the 'right' in the sense that a Chief Constable cannot refuse a license without a good reason, privilege does not enter into it and neither does 'extended by the police'. They 'extend' nothing being servants of the law and not lawmakers.
It is a shame that this idea of privilege prevails in this country.

Sorry Andy, can't let this one pass. As much b-s as we do have to put up with... the fact remains that provided one shows good reason for wishing to own and use them, an honest and upright subject of the crown (A.K.A..... U.K. "citizen") does so have the right to own and use firearms here.... and the police "Shall" furnish such a person with the requisite licence to do so, upon application, as is their duty.

I think, all in all, in their flustered, ignorant, panic many poor souls simply don't know that this is the truth and consequently talk a lot of neurotic tosh about the situation.

I would go further and say, many of us learn the hard way that part of how the Police deal with matters when problems arise is to give your buttons a damned hard push, then you get the chance to screw it all up for yourself. It's the easiest way for the Police to sort out wheat and chaff. However, if a some fortitude, common-sense, courtesy and patience is applied, no doubt Brit's guns will be returned. (going by what we have been told, so far, anyway)

Having said the above, it's a sore test and my sympathies go to Kevin in these difficult times.

already been answered but actually the police serve as unhappy administrators of a license that should be handled like any other license, driving, selling alcoholic beverages, working with explosives, etc etc

our "right" comes from as far back as Henry the Second's Assize of Arms in the 1100's
The Bill of Rights closely followed by the Declaration of Rights made in Parliament in February 1689 drew further detail to our "right".
Again reference in English Common Law in the 1700's (inextricably linked to the USA's current 2nd ammendment as it applied to all colonies including Australia!)

Its the 1800's that law and controls on vagrants, poachers and protection of game handed the "control" to the police and the subsequent Gun License Act brought in as a tax and the Pistol License Act that escalated the Police's involvement in gun licensing.

Our current Firearms Act stems from the amalgamation of all of these in 1920 and need to control vast numbers of guns under no real control following WW1.


It is sad that some people regard some basic rights as a privilege afforded to them by others
It is the reliance on ignorance and apathy and the threat of further problems/prosecution if we take action that keeps us under control.

I think rather that the 1920 Act was brought in to control pistols and rifles, not guns. Nor, I think, was it an amalgamation of anything that came before - rather an entirely new level of goverment interference with civil liberties, the real reason for which was parliamentary post-1918 fears of a revolution. The reasoningwas, I think, that revolutionaries armed only with shotguns could be cut down safely at 200yds by army riflemen.



The overt reason for the Act was 'armed crime'. A bit naive, perhaps, but it seems to have set the tone for all subsequent restrictions on private ownership of firearms in the U.K.

I had a similar situation with my ex. She alledged harrasment, i was arrested at work held for 10 hrs, my daughter was taken to a police station for her "own safety"! My rifles, shotguns ammo, spent cases and shells were siezed . The bomb squad opened my garrage cause it was allarmed with a 12g blank "allarm mine"(which are perfectly legal). At no time were any threats of violence, made or alledged. Shropshire police said they were following procedure! Aweek later the ivestagating PC offered me a caution.which i declined, as I'd have to admit to something i hadn't done.to accept it! 6 month later I was told that "i I'd got away with it". to which i repleid that I'd done nothing to get away with! All charges were dropped and my firearms returned. The BASC were about as mch use as tits on a chicken , throughout all of this! Good luck! THE TRUTH WILL OUT!!!
 
Wow! It seems to be a worrying but recurring theme that BASC have been useless when the s#*t hits the fan , even when ultimately it has been shown that there was no case to answer. Has anyone ever used the legal cover provided by BASC insurance to defend themselves? Is the cover even sufficient to do so? I have no idea of the kind of costs involved...

Sad but true, they have been like this for quite a while.
Personal experience of their 'help' was lots of jaw wagging on the telephone at my expense and no other intervention on their part.
Suffice to say I never renewed with that shower of ______ again.
Don't trust them, don't like what they do to shooting, don't like them being in bed with the police, don't like their mercantile mind set, basically a waste of time.
