Dear Sir,

I have an issue with one of the items bought from a member. I have received the package, not the item (its an empty package). As a seller he is responsible. Poor packing ...
It was delivered in my workplace and it's signed for. The delivery company delivered in the reception and gone. (Hermes) .. I have filled all required documents to claim it back.
Till now no response. Seller refusing to refund it. It looks like he is a SCAMMER. I don't know how to proceed.

Kindly help me.

A lot will depend on what the item was, for example if it was a knife, Hermes would have confiscated it, check to see if it is on it's prohibited list.
If you paid by credit card or Paypal then get in touch with them, as you may have some recourse through them

I think Hermes offer £20 compensation as a default unless extra is bought, and if no further compensation was paid for that will be all you get.
Try the Seller again, and explain ( as i am sure you have) about the weak packing which gave your item little chance to be delivered safely especially through Hermes.
 
Its a Swarovski BINO GUARD. Seller is saying its been signed ... But our receptionist will sign a 200 deliveries a day.

Envelope looks a bit flimsy for one of those, ref being signed for, I thought Hermes were doing contactless deliveries, or is it different at your firm, as I haven't signed for any delivery since CV19 started.

this was happened in Jan 23, still chasing the seller..

I am sorry your (signed for) package was damaged.
I am also sorry that it appears not to contain the item which you purchased (which I am guessing you will have paid about £20 for).
I am sorry that you and the seller have not been able to come to an amicable agreement.
I am mostly sorry that arising from this unfortunate incident, you feel to need to go onto a public forum and accuse others of a criminal act.
 
Seller is responsible up until delivery, after signature you have accepted the item .
Unfortunately not much room for manoeuvre now, just take it on the chin .

It was a private sale, so the seller has no legal responsibilities.

If it was the £30 Swaro bino guard.. it’s gone, it was £30 not £300, your recourse is with hermes really, it was signed for. Is this all worth it for £30??
