dont ask someone if they have permission

"Shoe on the other foot", I was on a permission on Saturday and while walking through to a high seat I must have passed 4 or 5 people walking or dog walking along a foot path that runs to the side of one of my fields. I always say hello to people as I see them as from their prospective all they see is some strange bloke walking with a gun over his shoulder :scared: but I am always prepared for one day one of them to anti.

As for what happened to you I feel for you, one hearing a shot so close is one thing, then when you ask them a question you get what happened I guess they are the type of people where you could have been badly hurt.

Keep shooting and remember you have the law on your side and if you see them again call 999 and make sure you report they have guns and have used force against you before I am sure that will get a far quicker response from the police.

Never give in to scum. I've had a 1/4 mile ride on the bonnet of a car when they crashed into mine and tried to drive off. Tracked them down. Also tracked 3x people that broke into my house, mid-winter no shoes just jeans and a t-shirt. Got them too. Do not give in, just keep your distance, use your phone ( camera and call police ). They then become the hunted. Shame is you can't shoot them.

ive been "advised" to withdraw my alligation of assault, as " if arrested they could turn the tables on me and insist i was the aggressor "

Brian,
If the Police have advised this, then this is absolute ********. Its a nonsense as, if indeed they did allege you were the aggressor, that allegation only being made after they are detained, wouldn't hold much water.
If I recall, a few weeks ago you had a run in with a shell suited shot gunner accompanied by an air gunner which could have went tits up. where is your permission, the middle of Easterhouse!.
Seriously though, if this is the second time in as many months, its time to adopt some sort of proceedure whereby you need to record these encounters on a mobile phone.
PM me re the advice you have been given.
Bob

Brian,

Do not withdraw your allegation - if you would like some advise - feel free to PM me (as an ex copper)

Mike

I would further support the advice above Brian.

There is a thing called Dislocure that came into place a few years ago whereby the police must report all the facts to the prosecution service, which would include any statement or allegation made by the accused in their defence during an interview for example. The PF would then, based on that information decide on a course of action.

As Bob rightly says, a counter allegation made several days later by the suspects who had been afforded an opportunity of making a complaint themeslves about you during that period of time (should that be their chosen line of devence when interviewed) would not carry much weight. Biggest problem as you know in Scotland is corroboration of an allegation. It does not necessarily mean you need a witness as there are other corroborative means available to support a complaint.

If you have been told by the police to withdraw your complaint it is an embarrassing attempt to write off work I am afraid and you should not let it rest...

who in there right mind is going to believe that the sole victim with the broken tooth was the aggressor against two cammo clad, armed poachers !?

personally I would be making damn sure any such "advice" was on record and reported. That is shocking!

That's what is meant by, 'other corroborative/supporting evidence...'

ive had a call from the police , there is little or no chance of catching the guys,, gave me a bit of a dressing down about approaching them and gave advice as to what to do if i encounter anyone again

they didn't go out and take footprints and tyre tracks, then match up the tyres against wheelbase dimensions and look into road cameras that are within a 5 mile radius of cars matching those descriptions?

surely they don't watch enough CSI!!!

mate, sorry to hear that, bud sadly these days few people end up getting prosecuted against crimes they commit, and these days spending time in prison is more comfortable than at home or in a retirement home,,,a sad reality really.

If I was you I'd be proud to have stood up for what I believed in, but perhaps learn and do it slightly differently next time ;-).... up and at 'em soldier!

Granted there may be little chance of them catching the guys.
However why should you get a dressing down - you only reacted to a situation you were unfamiliar with.
Next time you will possible react differently; but you should not have been given a dressing down.

Dear Scots_stalker

There are thousands of stalkers reading this, and although they may not all reply we are all saddened by your prefectly legitimate request and the violent response in reply.
We also hope you have a speedy recovery from the trauma, with the best way being to get back out there, accompanied at first, then on your own when you are feeling more confident.
Nil illigitimo carborundum - Dont let them ruin your pleasure as that gives them a double triumph.
I dont know where you are in Lanarkshire but perhaps a stalk elsewhere might help? If this is a better option for you let us know. I am sure we SDers can arrange something.
Best wishes

Newkid

Just read this post, and its made my blood boil!!

For a start the police should take this as a very serious matter. Not only did the two idiotic morons that assaulted you have firearms, they were very possibly illegally held.

As far as I am concerned they should be flogged in public, and then given 5 years hard labour. I hope they catch the scum, and if they read this I certainly hope they feel the full force of the law upon their shoulders very soon.

Keep your head up and carry on with your stalking, you are much better in every sense of the word than those cowards.

tbh its affected me more than i thought , replaying it over and over in my mind gives me a knot in my belly and i shudder at the thought of how different the outcome could have been

There is no indication that the police haven't taken it seriously. They would have taken the statement from the victim and reviewed any evidence and made decision based on that. It appears that there are no witnesses and no forensic evidence. Needle and haystack spring to mind in terms of catching the perpetrators. All other comment and opinion on the assailants and whether the firearm was illegally held is pure conjecture. Unfortunatley not every FAC/SGC holder or user of air rifles necessarily has high morals and/or ethics, so it does not follow that the firearm was illegally held.
